Scenario
You have been lucky enough to have gained work experience with a firm of solicitors. You are asked to carry out some background research for one of the partners and his clients.
Client 1
Raj was moving and decided to sell their car. They advertised the table in the local free paper which came out on a Tuesday. A day later Stu left a message on voicemail saying he was interested in the car his son, would pay £750 for it and collect it on Sunday.
Stu arrived at Raj’s house on the Sunday to find the car had already been sold.
Raj into a hotel for a short holiday and left their leather jacket in their room when they went for a swim. When they got back the jacket was missing. As if that wasn’t bad enough Raj tripped on some loose carpet in a corridor and broke their leg.
Any attempt to discuss the situation with the hotel always results in Raj being referred to a clause in their standard contract:
S. Weller Ltd, proprietors of Pickwick Hall, cannot accept liability for personal injury to guests, loss or damage to guests’ property howsoever caused which might arise during the guests stay at this hotel.
There was also a notice at the front desk carrying the same wording.
Raj owned a jewellers. A customer chose a diamond ring and then asked if they could pay by cheque. Raj was happy to accept the cheque and chatted with the customer for a while. The customer left taking the ring with them.
The customer then immediately sold the ring to someone else. The cheque did not clear and Raj has decided to sue the person who had purchased the ring from their customer.

Client 2
A country park owned by a local authority was popular with people living in the area and on hot summers days the boating lake was always busy. Fred, aged 16, and her parents went to the lake and hired a boat. Once they were out on the lake Fred dived in to the water and hit her head on the uneven bottom of the lake. She broke her neck and became paraplegic. There were notices around the lake prohibiting swimming but these were often ignored. The local authority knew this but took few steps to stop people swimming. On the day the accident happened there were a lot of people paddling in the water
Fred sues the local authority claiming damages for her injuries.
