1. Discuss the first Supreme Court case that supported the states’ right to required involuntary vaccinations.
a. How did this case affect the growth and development of Public Health in the US?
b. What impact did this case have on disease transmission at the time?
c. What impact does this case have on modern-day Public Health efforts to vaccine the public?
d. Include how does this case relates to the current Corona Virus Quarantines.
2. Due Process Clause; In the Constitution, the phrase “due process” appears twice: in the Fifth Amendment and in the Fourteenth Amendment. Both Amendments guarantee due process when someone may be denied “life, liberty, or property.”
a. Why is due process important and how does it apply to Public Health.
b. Under what conditions would Due Process be required in public health?
c. While there is no mandatory list of required elements, Judge Henry Friendly, in his article titled “Some Kind of Hearing,” (Links to an external site.) created a list of 10 procedural elements that due process should include. List these 10 elements and briefly identify how 3 of them relate to public health.
3. Much of Public Health is based upon the control of nuisances.
a. Discuss the “law of nuisance” including its origin;
b. Distinguish between public and private nuisances and;
c. How this difference relates to public health
4. Isolation and quarantine have been used historically to protect the public from exposure to contagious diseases.
a. Discuss the similarities and differences between isolation and quarantine.
b. Identify the specific constitutional legal basis used to imposed isolation or quarantines.
c. Provide examples of when isolation and quarantine have been used to protect public health.
d. Discuss whether these measures been effective in limiting contagion and whether you believe they are justifiable in modern times.
5. Discuss the differences between Civil Rights and Civil Liberties. Give examples and specify how this difference relates to Public Health.
